
Controversies and suspicions are alleviated when transparency and full disclosure is in evidence. Statements to the effect that such and such and so and so was not forthcoming at a previous time in history does not make non-disclosure more palatable. 170,000 documents concerning Ms. Kagan's tenure with the Clinton administration have been released but according to the ranking member of the senate judiciary committee there are several thousand more which have not been released that deal with specific areas which members are interested in. A privacy rubric set into place by Ms. Kagan's representatives coupled with the failure of the National Archives to submit a standard acquiescence certification declaring complete and full disclosure of documents may set the stage for additional disjunction of future hearings for the nominee.
